By securing a yacht or utilizing our Service, you consent to adhere to these Terms. If you do not concur with any section of the terms herein, then you are prohibited from using the Service.
2. Service Overview
CommonsRotunda offers high-class yacht charter solutions, encompassing:
- Day-to-day yacht hires
- Evening sails
- Business gatherings
- Exclusive celebrations
- Extended voyages
All offerings are provided based on their availability and climatic conditions. We maintain the authority to alter or halt operations at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are to:
- Have achieved the age of at least 18 years
- Submit accurate particulars fully
- Remit the needed prepayment as detailed in your reservation acknowledgement
- Accept these Terms & Conditions
3.2 Confirmation
Reservation validation occurs only after payment is registered and we provide written affirmation. We retain the prerogative to decline service to any party as seen fit.
3.3 Availability
Yacht bookings are dependent upon boat availability and approving weather. We shall strive to accommodate your requested timing and dates.
4. Payment Terms
4.1 Pricing
Quotations are given in € and incorporate all relevant taxes unless indicated otherwise. Pricing is adjustable and subject to modification without prior notification.
4.2 Payment Schedule
- Initial Payment: 50% of the entire yacht hire cost due at the time of booking
- Outstanding Balance: Payable 48 hours prior to yacht departure
- Supplementary fees (if any): Payable when the charter concludes
4.3 Payment Methods
We welcome payments via major credit cards, electronic bank transfers, and certified bank drafts. All payment processing is executed through secure, encrypted frameworks.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction costs
- Between 24-72 hours prior to departure: Refund of 50% of payment
- Under 24 hours before departure: No reimbursement is possible
5.2 Weather Cancellations
Should our captain decide weather conditions are too hazardous, we will propose to:
- Postpone your scheduled charter to another date without any extra charge
- Issue a full refund if rescheduling proves impractical
5.3 Mechanical Issues
If mechanical issues arise with the selected vessel, our attempt will be to present an appropriate replacement. If this is not possible, a complete reimbursement will be accorded.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Adhere to every directive given by the crew
- Don safety apparatus as needed
- Disclose any health conditions that could jeopardize their safety
- Stay in assigned spots within the vessel
6.2 Prohibited Items
These items are not allowed on board:
- Glass vessels
- Illegal drugs
- Guns or any form of weaponry
- Inordinate quantities of non-alcoholic beverages (beyond modest consumption)
- Animals (with the exception of those previously authorised)
6.3 Conduct
Guests are required to behave respectfully. Any charter can be terminated at any time without refund if a passenger's conduct is deemed a safety threat or is disrupting for other passengers.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped at the amount you have spent on your yacht booking. We are not liable for:
- Injuries caused by passenger negligence
- Theft or destruction of personal belongings
- Secondary, unplanned, or punitive liabilities
- Delays attributable to weather conditions or scenarios beyond our control
7.2 Insurance Coverage
Our organization maintains inclusive maritime insurance for our vessels and operating procedures. Passengers bear responsibility for their own personal travel and property insurance.
7.3 Assumption of Risk
By opting to participate in our charter offerings, you recognize that boating involves intrinsic risks and you agree to take on responsibility for ensuring your own safety.
8. Modifications and Itinerary Changes
We reserve the discretion to adjust itineraries, passages, or schedules due to atmospheric conditions, issues of safety, or other operational demands. We will exert our best efforts to supply comparable alternative arrangements.
9. Force Majeure
We shall not be held accountable for postponements, cancellations, or alterations instigated by unforeseeable circumstances beyond our command, including but not confined to:
- Adverse climatic situations
- Catastrophes of nature
- Governmental decrees
- Shutdowns of ports
- Technical malfunctions
10. Privacy and Data Protection
We'll handle your personal data consistent with our Privacy Policy. By engaging with our offerings, you acquiesce to the collection and use of your data as indicated in the mentioned Privacy Policy.
11. Intellectual Property
The contents within our website, comprising of text, visual graphics, trademarks, and photographs, are shielded by laws on copyright and trademarks. Replicating, disseminating, or crafting derivative works without our express consent is prohibited.
